Does anyone know if a physicans office can find you financially responsible for a bill even though you didn't sign for financial responsibility. I was told by the collection agency that because I carry the insurance on my son that I am liable for payment.

See, the thing is my ex-husband never helps with my son's medical bills and he took my son to the doctor that day while he was visiting him in Dallas. Apparently my ex put me down as the one responsible for the bill...can they do this? They are threatning to garnish my wages.

Whether they "can" find you financially responsible is irrelevant.

They can't do anything without a court finding.

Collection agents will often say and do anything to try to get some money.

Write a letter to the collection agency and the physicians office. Tell them in the letter that you didn't take the patient to the doctor's office, you didn't authorize the visit, you didn't sign anything and you didn't approve anything and that you are not reponsible for any charges.

Tell the collection agent that you understand their postition, but that if they call anymore you will have to consider talking to a lawyer about harrassment.

Don't let them bully you.


Several people have agreed that because you carry insurance on your son that you are responsible for any medical bills that he might get anywhere. This is not true. I could choose to buy medical insurance on your behalf and it would NOT make me reponsible for any of your medical costs.

Your son has insurance through you. Yes, I am afraid that means that they are billing your insurance, and you are responsible for the rest that the insurance does not cover. Unless you have a divorce agreement that says he will pay part of it. You can always take your ex to small claims to pay the rest of the bill.

If it is your policy, then it is your responsibility unfortunately. I suggest, for now, working with the collection company and work out a payment schedule to get them off of your back. If you're making payments (even if they're small) they can't do anything to you. Then get a lawyer and make your husband pay child support. He's a low life and needs to get on board with his share of the responsibility.

the one carrying the insurance.
Next time, be sure your ex husband
doesn't take him to the doctro w/o your permission.

Yes, I believe they can do that. You need to pay it and then beat up your ex (so to speak). You need to bring it to his attention and try to split it with him or get reimbursed for it.
