Generally if a person dies while under the immediate care of a physician, there is not an autopsy. However, the hospital may request permission to conduct an autopsy if the death did not seem to be a consequence of the treatment.
You could always commission an independent autopsy at your expense once the body is released to you.

I'm sorry for your loss. You need to get an attorney if you feel the doctors or the hospital were negligent. It will most likely be a civil case since the doctor chose not to do the surgery. There are several lawyers that will be glad to examine your case. There are many specializing in medical malpractice and give free consultations.

It depends on the situation. I know of someone that died because surgeons around the US refused to operate on him. Nothing was done about it. Also, in some cases the doctor could say that based on the situation the operation was not seen as necessary and therefor not performed. If you're wondering about a specific case you'd probably have to consult medical law professional/books.

Yes, but it could cost you if the investigation turns up nothing. They could claim that it would of required an autopsy to see if surgery was needed for instance. The doctor could also say they were not qualified to help, nor knew somebody that was.

If you are family of the person who died get a lawyer, then have your lawyer subpoena the medical records, then make sure your lawyer finds what is called a forensic nurse. She will go over the charts and records with your attorney. If there is reason to suspect foul then go forward with your case.

It depends, if the doctor didnt do the surgery on purpose then he/her has to go to jail. But if he was too late, it is not his fault.
