I will miss two days work and have whiplash... nothing that serious, just pain that will probably go away in a few days. I just want to know if anyone knows the fair amount for pain and suffering? I know they will pay for my medical and loss of hours... just want to know how much for my inconvenience and pain.

Okay for all of you nasty people who answered rudely... I am NOT trying to scam anyone... BUT there is no reason that I should go through this pain and not have some compensation. That's like saying "hey, you broke a leg ... think of people who got paralyzed!" Uh, DUH- I know it isn't the same... that doesn't mean that people should get away with causing pain to other people for FREE.
I'm sure if it were you or your children, you would just suck it up- yeah right!

Depends on the venue in which you live. I used to do auto injury claims in Kansas and Missouri. With the information that you provided you may not even qualify for an injury claim. However, if you live in a state that does not have a threshold (meaning no requirement for qualification of a claim) they would offer you a settlement for a signed release of all claims. Assuming that you just went to the doctor or ER 1 time, I would estimate a settlement of $200-$400 above your medicals. If they offer that amount I would counter offer with about $500-$700 more to see if they will negotiate. Typically they will not negotiate with you if your offer is unreasonable. If I would have offered someone $500 and they counteroffered with $10,000, I would not have changed my offer. However if they would have counteroffered with $900 I might have accepted or countered about $700.
With a minor injury like yours I would not suggest an attorney as they will take 35% of your settlement, including the medical and wage loss. You would actually end up behind. Also - with the wage loss, you should be able to collect your earnings before taxes. That is a nice way to make a little extra. Injury settlements are tax free. Also ask the claims rep you are working with who the medical needs to be paid back to. For example in Kansas we would have to pay back the injured partys auto insurance company but in Missouri you could double dip. Meaning that your auto insurance company would pay the medical bills and you would get paid again. Some states will not allow you insurance company to subrogate (recover) the medical back.

No real answer possible here without knowing the full picture (state, injury/prior medical history, lost wages and such), If you go to an atty you are going to lose 25-40% of what you recover (and that includes the medical bills, so unless the atty gets those paid in full and gets the provider to reduce their bill by an amt =/> their fee you could wind up netting less in a settlement)..best advise is check the statue of limitations for your state (the amount of time you have to settle your claim..either look it up online or simply ask the person handling your claim)..make sure there are no further complications and attempt to negotiate a settlement you feel is fair..if they cant meet your expectations, consult with at least 2 attorneys (to get an idea of your case, consultations are generally free or inexpensive)..

Depends on the circumstances of the accident. If it was your doing, the terms of your insurance policy govern, and you will probably recover nothing more than the auto damage less deductible -- and, unless you have comprehensive, not even that. If the blame lies elsewhere, then the other insurance will need to be contacted. In that event, see what they offer by settlement. It won't be as much as you would like, but it may be enough to convince you to go away without suing them. If they are recalcitrant, talk to a lawyer -- lots of them make a good living dealing with cases such as this. But the first thing to do it to talk to your insurance company -- do that NOW.

First we need to know which state your auto insurance is in....Hopefully not NJ unlesss you carry the full tort option on your car insurance. Because whiplash is medically impossible to prove or disprove your award for pain and suffering will most likely be minimal. The only tangible loss you have is your lost hours of work. If you receive anything more than 5k I will be suprised

Depends on your state, if you're a "no fault" state, or if you've elected for limited tort or no tort.
If you have "full tort" either on your policy, or decreed by your state . .. for two days, I'd guess they might offer you $100 to $250, if they decide to offer anything at all. I don't see them even agreeing to $500, so if they offer you SOMETHING, I'd take it.
If you're insistant on getting money, you'll probably have to sue, and you'll probably have to PAY the attorney up front - I don't see an attorney taking this on a contingency basis, with no serious injuries.

basically it depends on how much the total paid loss is and trust me, you won't get a lot of money. The only thing I can tell you is try not to accept the first offer, they usually come back with a counter offer.
