most plants have seeds, what makes a plant a fruit is where it's seeds are. for example, a jupe is a fruit with it's seeds on the inside, like an apple, a tomato, or a cucumber {all fruit}
so, just because it has seeds does not make it a fruit.

as to the rest of your question, the federal government in america has demonised marijuana {look into the history of president hoover} in it's zeal to keep mexicans from its borders... mexicans smoke weed, so mexicans are crazy.
marijuana is scientifically proven to be beneficial if used correctly, and cannot make you crazy no matter how you use it. anyway, the fda would never recommend you eat the seed, even though there is absolutely no thc in it. in africa, particularly the west coast, marijuana seeds are ground and used in baby foods.
there are a lot of very good, very accurate, well researched books on maryjane. the most recent in the past years that i highly recommend is called marijuana, a history. maybe if this question was at least quasi serious you can get more info.

Botanically fruits are defined as the result of a flower turning into a pod containing reproductive seeds and residing above the ground. A vegetable is the stem, stalk, root or tubor of a plant. In many cases this differs from the FDA as corn, beans, peas, etc are considered vegetables by the FDA. Marijuana is not considered a food by the FDA so it is not part of the food pyramid.

I don't know where you got your professional expertise in botany but just having seeds does not make something a fruit. What about plums that have pits - are they failing the fruit test? What about basil and dill herbs that have obvious seeds - are they fruit? What about chives with seeds - are they fruit?

Not every fruit (even if something was a fruit) is specifically listed as required in that pyramid - just "fruit - make your own selection".

Go back to those marijuana seeds you are recommending and try for a more-clever question.

No, it is not a fruit. Technically it is an herb and it is mentioned in the Bible (Gen. 1:29) as being OK to consume ☺
