For example, say you are staying at a hotel and the only spot to park is in a handicap parking spot. Can a police officer that just so happens to be passing thru the parking lot, issue a ticket? (Mind you, the hotel staff itself has not called the police to rid the car of the spot.)

Good God!! i'm only ASKING out of curiosity! HAHAHA! I work at a hotel and was just searching for information to toss back at guests who want to ILLEGALLY park in the handicap spots. thanks for the passion guys. WINK

Of course they can. What would be the point of marking a space handicapped if the police cant ticket people for parking there? And by the way, if you parked in a handicapped spot and got a ticket for it, instead of wondering if the police did something legal, perhaps you should re-examine your moral values that seem to make it acceptable to park in a handicapped spot and then complain when you get into trouble about it. You deserve what you get.

Yes, they can. And I have on more than one occassion. I have written them at hotels, shopping centers, hospitals, and anywhere else I felt the need. There is one particular Subway restaurant that I stop into for lunch every day where people like to park illegally in the fire lane and handicapped spaces right out front. I usually give them a few minutes to move while I'm eating. But, if they are still parked there when I finish eating and make it out to my car, they're getting a ticket. Most of them don't move, though, since I am a plain clothes officer and drive an unmarked car. As I see it, though, illegal parking is illegal parking. Most people don't even argue about it. They know they were wrong and just pay their fines.

Yes the officer can issue a citation for being parked in the handicap parking space. The parking lot in not private property, its whats known as public access, same as driveways to homes.

Yes - they can for handicap parking violations. They can also arrest for DUI on private property. They can issue citations if they have an arrangement with the owner or if the property has normal public access (such as a shopping center parking lot without a guarded gate)

Yes. And a good thing too. My mom requires the use a disabled parking spot and there's been quite a few times people feel this is their only option. Heaven forbid if someone actually walks a few blocks to get somewhere .... nah, screw the disabled person who has trouble even getting out of the car.

Frankly I think parking there and not needing it should come with getting the car towed and license revoked until people learn a lesson.

Yes they can.Walmart is private property,pretty much every business is private property.All businesses are required by law to provide parking for disabled people.They are also required to make sure these spots aren't taken by able bodied people.You should be thankful that you don't need to use a handicapped spot.
I'm not handicapped and it really pisses me off when I see these self-important people abusing the system because they "Are just gonna be a minute".
You won't find much sympathy on here.

Yes he certainly can and should.

I have found that quite a few places don't have enough handicapped parking when I am able to get my mother out of the house for a bit.

Guy I know in Cali got TWO tickets because the rear wheels of his truck were over the lines into the NEXT handicapped parking space!!

Yes! It doesn't matter where you are breaking the law, if you are breaking the law and get caught, tough! Pay the fine and leave the handicapped spaces for the handicapped.

I can't comment on this but it reminds me of my pet peeve: Special parking spaces for expectant mothers. Now I can understand that they may have a little more difficulty getting around but I happen to have a sizable belly myself. So why shouldn't I get a special parking space?
