Governments do not have "rights." They have "powers." Only the people have rights. As the Declaration of Independence says, government derive their just powers from the consent of the governed.

Thus, if we, the people, give government the power to tell us what to wear, then government has the power. But if we don't give it to them, then they don't have it.

Sometimes, governments take action illegitimately. This occurs when the people have not consented to something, but government does it anyway.

Sometimes, the people in an area will clamor for restrictions on clothing as a way to reduce gang violence. In such cases, a city might pass a law that outlaws certain gang colors or particular pieces of clothing. But these laws don't generally tell you what to wear -- they tell you what NOT to wear.
