Last school year my younger sister was in a fight. The school was for warned before the fight that there were problems between my sister and the girl that she fought. My sister and mother asked for escorts to my sister's classes and constant supervision from the security at her school. The fight happened anyway at a school dance. There was no supervision and the other girl shouldn't even have been at the dance because she had recently transfered schools. My sister knocked the girl out in one punch, nobody was seriously injured! Now the school and a police reporter are filing charges against my mother for aiding to the delinquency of a minor after my sister and mother asked for help from the school to prevent this from happening. My sister was punished (suspension) and we were told that everything was taken care of. Now there is a huge court case with a lot of false reports from the girl and her friends... nothing on my sisters side (one sided argument) and the district attourney...

didn't even do an investigation! Everything is so phony and a lot of what the accusing party is doing is against the law... how will this turn out in court? What are your opinions?

Let me add this. The fight was instigated by the other girl... she was stalking my sister. She would follow her around school and call her names... seriously following her everywhere she went, even until my sister was picked up from school. I am not being biased because this is my sister... my family doesn't condone fighting... like I said my mom went to the school and asked for more supervision... so where was it when the fight happened? it could have been prevented if the faculty at the school were doing their jobs at the dance and actually shaperoning! this other girl was the one asking for the fight, and the school didn't do anything in their "POWER" to try to stop it!

Also, how can the case go throught court without wittnesses from both parties? The girl my sister knocked out isn't the one pressing charges! And how can the opposing side turn in their wittnes list late, and add wittnesses 2 days later?

And again... the charges are not on my sister... they are on my MOTHER for aiding to the delinquency of a minor! my mother did everything she could to stop it. should my sister be pulled out of activities because some girl is harassing her?

i think that if i were a judge i would say that nobody even got hurt which is not fair

You need a good lawyer and a clearer account of what actually happened. The story you tell makes your sis sound completely innocent, and as though there is a huge conspiracy between the other girl, the school, & the police!

Not very likely, though if it were true you'd be no better off 'cos you'd just have to take your lumps.

The fact is that if you slug someone FIRST, even if they subsequently beat you to within an inch of your life, you're still wrong. In court, the person who was hit first can justify almost anything they do after that by saying they "feared for their life".

PS It doesn't count as a "fight" if you punch someone and that punch knocks them out. That's just assault.

If the girl was "knocked out in once punch," how can you say there was no serious injury??? The punch is an injury, and probably a concussion.

Assuming the other girl instigated the fight -- which I'm not at all sure was the case -- this is a perfect example of why school violence hurts everyone involved, even the "winners."

Why is it the school's job to watch your sister? Sounds like just another case of bad parenting to me. It sounds like your sister could have self-control issues. No matter, as long as you are honest and respectful and are able to keep control of your emmotions everything should come all right. A lawer could be a big help but that does cost a bit.

A juror would probably believe the other girl, just for the fact she has witness testimonial and your sister has none. It also sounds like the other girl has the school and law on her side. Matbe you are a little prejudiced becuase this girl is your sister? It seems to me there is probably more to this story than you are letting on. But that is is just my thought.

Schools have ABSOLUTE POWER over school matters. Get yourself a lawyer, but be careful, many do not want to take on such an adversary, so look for one who specifically advertises for such services.
