You have to figure out if you have the emotional energy and the grounds to sue him to get your money back. Maybe small claims court would work best.
You can change attorney's by simply telling him you've gotten a new attorney. Although if he's neglecting your case, he'll probably never notice.

You can ask the judge to dismiss the attorney for you. You can come right out and fire him yourself. If he is actually using drugs and giving you a poor representation in court you can sue him for poor performance of duty. He is an officer of the judicial system, his performance should be about reproach.

You need to report him to the bar association. They will explain to you what to do next and help you find a new attorney.

You can always fire your attorney and get another one as long as the case is still open.

If you don't feel like this person has your best interest in mind, fire them.
