I am a GREEN CARD holder. I have open case st NY County criminal Court.
I have made deal with DA .I have plead guilty A missdemeanor -Petit Larseny
at court on August 10 2006 . I need to return to court in 6 Months .
If I will stayu out of troble for 6 Months I will withdrawll that plead and will
plea guilty DISORDERLY CONDUCT wchith is only a Vioation and the fine will be 95$.
My question : CAN I TRAVEL ABROAD WITHOUT PROBLEM WHENN RETURNING DURRING THIS 6 MONTHS ???OR NEED WAIT TILL THE CASE BE COMPLITYLY RESOLVED?????
What is the status of my case durring this 6 Months Do I have ENTERD CONVICTION FOR MISSEDMEANOR to my record for this 6 Months while i am waiting ?????

Is this your only conviction? If so, no problem, but if you have a couple of other misdemeanors then you need to consult an immigration lawyer because you may be what is called inadmissible and while in the US you dont run any dangers but if you leave and try to come back then you would be place din removal proceedings. But if the only offense, then you are fine. Travel but make sure you take with you proof of the disposition of your case and that you paid the fine in case you come across a new Homeland Security employee who does not know his stuff and tries to make a bid deal about it.

No problem unless there is a court order against you leaving the country, if so, you may have a problem coming back, or I should say definately have a problem, under the new homeland security rules.

You need to ask the judge for permission. Once you leave the country, or the state for that matter, you have broken your probation. The only way to be really sure is to ask the judge. He is the only person who can tell you if it's ok or not.
