A friend told me that if a person gets stopped in the car by DPS and they find even the tiniest amount of drugs, that is now considered open consent to search your home. If this is true, just how far will they go in this war on drugs??????

Tell your friend he/she is an idiot if they believe that.

Police MUST have a search warrant to search your house. Anything less is a violation of the 4th Amendment to the Constitution.

Only exception to this is if YOU give them permission to search, in which case they'll have you sign an affidavit stating that you gave them permission to search of your own free will.

Its not true but it would give them probable cause for a search warrant. The answer is no they can't search your home without consent or a warrant.

No. But it might be used to get a search warrant for your residence, your storage unit, your office at work etc.

police can enter your home if there is imminent danger to them or someone else or contraband is in plain sight no warrant needed

if it was really a war on drugs they wouldn't encourage poppy growth in afghanistan
