This may depend on where you live and what your state's regulations are, but in Texas, there is a minimum percentage that creditors can not touch. This is to protect the lender (finance co. that loaned you the $ for the home) and the homeowner (homestead). I suggest that you contact your state's savings and loan commission/department and ask this question. In most cases, a regular creditor can't supercede the noteholder (except IRS). However, they may place a lien/judgement on the property that is recouped when the property is sold or refinanced and taken from any gains before you are paid.
