On top of everything the posted a eviction notice yesterday due to the faact that they are going to get this propety ready for sale. St the time of the accident she had just started a new job about four weeks earlier. So she had no health Insurance. I'm not sure what our poition is?? I really feel that we need to get a good Lawyer and sue them ... I just need some answer's please help someone. Thank YOU

Why would you sue? You didn't mention what the landlord did that caused your sister's injury.

Please explain...

Accidents that occur on private property are often not covered by health insurance, because it's the owner's responsibility. They have homeowner's insurance to cover that fact. However, the fact that your sister was renting may change that; I'm not sure. You should definitely talk to a lawyer. Most will see you once for free and tell you whether you have a case.

As far as being evicted, if the owner is going to sell, your sister has the rights outlined in her lease. You should read that and take it along with you to the lawyer.

I hope your sister gets better.

Wait who are you going to sue? Seems like it would be the sister with the injury.
Do you have renter's insurance or liability? If not she would have to go after the Landlord.
Can they evict you to sell the home, YES!! Check your lease though and see how many days notice they need to give you. Most times its 90 days. I don't see a reason to get a lawyer involved unless they are only giving you a couple days or weeks.

You need a lawyer first. The problem is the time elapsed and what you hope to gain. You will have to prove that the property caused the fall and it couldn't have been avoided. As you are the renters you should have been aware of the problem and notified your landlord. If you had notified him of let's say...a faulty stair or a loose board, and that caused her fall....and he had ample time to repair it between notification and fall...then he becomes liable.

If your sister tripped over your rug or a childs toy and toppled down the stairs....you may be liable for her fall...not the landlord.

If there was no provable negligence...then the fall will be ruled accidental and nobody's fault (perhaps her own carelessness).

I agree that you should get an injury lawyer some of them even don't take money from you unless they settle a win and then it is only a percentage so of course they are going to try and fight for you it is a win, win situation in that sense. As well She will probably experiance pain in her bones later in life being subject to arthritis... It is very stressful but in the end she should be conpensated for being unable to work, pain and suffering,and much more.
