It's worse to insist. Asking them not to take a PHOTO politely is not bad manners if you say it tactfully, and IT IS ILLEGAL to take a stranger's photo without there permission in most areas, so the law is on the side of the person who says "Don't take my photo, please!" After all, if a person is not feeling well or are not "feeling up to" taking a photo, it would be rude to selfishly insist on having one's way, especially when you know they hate taking photos. With persons like that, you will appear rude if you keep insisting, NOT THEM. And if you feel like you are going to have to be rude, to get them to leave you alone, that is sad, because it should never come to that if someone would just use empathy.

Bad manners is having a camera pointed at you by some stranger who didn't even say a word or make eye contact. I live in a tourist town and this happens a lot. It's freaky and very annoying. Being asked is the height of politeness in comparison.

If someone insists on taking a photo, even if you have asked them not to, that goes beyond bad manners. It is, in a legal sense, trespass and a chargeable offense.

Worse is insisting on the picture. It's almost like an invasion of privacy if the subject doesn't want it taken.

the one who insists. not all people like being photographed so forcing them to puts you and the photographer in a very awkward and precarious situation. beatings always ensue.
