Interesting question. Assuming that it happened as the Christian scriptures describe it, penetration never took place, but Mary became pregnant nonetheless. While she was not forced to have intercourse, she did become pregnant without her consent. When she was told that she was pregnant, she accepted the fact and was even ecstatically happy about it when the detail was added that she would bear God's child, so I doubt she would press charges.

if I'm not mistaken god came to Mary in a dream and told her of her purpose on this earth. I wouldn't considerate rape more like a seduction.

Read the book.

Luke 1:38 And Mary said, Behold the handmaid of the Lord; be it unto me according to thy word. And the angel departed from her.

She was a willing participant. She felt humbled to be a part of such a special aspect of God's work.

Mary was a Christian.

I'm sure she was fine with having the son of God.

Rape is physical violation, and she wasn't physically violated.

So no, it wasn't rape.

Absolutely not. If you read in the gospel, when she received the message from the angel, her response was "behold the handmaiden of the Lord; let it be done to me as you said". She was a young woman who loved and believed in God and was obedient to Him.
