laws are different in each state---in Texas, if you are on the lease and they are listed as a tenant on your lease, send a certified letter, return receipt requested,advising they have so many days to vacate.
If you are both on the lease, and you are in good with the apartment staff, ask them if they will do you a favor and send you a notice to vacate. That will get rid of the roommate and you can have your peace and quiet.
Been there, done this.
Believe me when I say you are better off with no roommate(s).

If both or your names are on the lease agreement, you can't make him leave unless he wants to or until the lease is over. If the lease is in your name, give him 30 days notice and tell him/her that he/she is out. Honestly the best thing to do is to find your a new place, it is less drama.
