Yes you have the right to get a divorce. Your rights in a marriage or a divorce are the same regardless of your status. The judge will determine whether you can receive maintenance from your spouse and that will depend on how much money you make, property etc. Your immigration status will have nothing to do with the decision the judge makes, except maybe what your earning potential is when he calculates how much maintenance you would get. If you do not have a work permit, he might take that into consideration to decide that your income is not secure and that you should get maintenance. Hope that helps.

Any illegal question voids any legal contract. If you are a citizen of the U.S. the law books written for the Dept. of Justice are the jurisdiction. If a citizen is overseas, the law books written for the Dept. of State are the citizen's jurisdiction. Overseas, the U.S. government does not govern the local divorce rules of foreign countries. Europeans do not have lawsuits like we do. So, I would venture to guess, the rules about your residency will come before any other legal matters. Once your back in your country there will be little recourse under U.S. laws.
Child support is something else. Whoever has the child and the child's welfare responsibility will get some recourse in a court of law.

I agree with Nicole. However, if you are in America, the unfortunate truth is yes you do have the right. Use of the legal system isn't based on citizenship.

as long u are married, u can stay in the USA.
the INS/DHS say u can not, but in fact u can and they can not really deport you.
u can of course divorce and stay in the USA until u are legally divorced.
u can collect money too.
u can do lot of things without proper documents, u can legally open a business and make money....but for the INS u can not...
but who cares of what say the INS???

In a perfect world, yes. This world isn't perfect. After you get your divorce, your ex will fink on you to get you deported. Then, although you may be entitled to "community property" you won't be able to collect. Good luck with that.
