I was on vacation when my dog walker was out with my German Shepard, Tyson. A car went by and a Golden Retriever jumped out of the backseat window, and attacked Tyson and the walker. After the walker broke up the fight, the guy in the car claimed my dog to be dangerous - since it whooped his dog pretty bad apparently. However, I was on vacation and had to deal with a lot of nonesense over the phone because of this ordeal. The walker had to receive medical attention and Tyson was quarantined. I personally don't have any bills, but a ticket since Tyson was barking outside too long (because of the quarantine, he's an indoor dog) for $50. More than likely that complaint was filed by the Retrievers owners as they turned out to live up the street from me.

I seriously had a real pain on all 10 days of my vacation because of this and would like to sue for some type of compensation.

Does anyone know how would go about doing this? Where do I start? What do I file it as? Thanks in advance.

You are 1,000% in the RIGHT here. The retriever's owner did not keep his dog under control (jumping out of the car) and the dog hurt a human. Two major complaints for you to file.
The pet sitter should go after the retriever's owner for loss of time for her work, injury to self and endangerment to her client's dog.
Good for your GSD for kicking that dogs' tush! That'll teach the retriever to start something he can't finish....lol
I work with retrievers in rescue and they are NOT the happy-go-lucky dogs that the media likes to portray them as. This dog was clearly ANIMAL AGGRESSIVE.
Start with a police report filed by both you and the pet sitter. Get copies of her medical bills and look into pain and suffering for the pet sitter. She deserves it! Next stop is animal control, file a report with them as well.

I didn't know that Golden's was that aggressive, but it seems that your Walker would have a right to pursue this. You said that Tyson was quarantined....what about the other dog? Was it quarantined? The Walker shouldn't have gone into the middle of fighting dogs, But I do hope they are OK?

I don't know if taking action against someone for giving you inconvenience on your vacation or not, and if this person is living close by you, chances are you are going to have your hands full with them harassing you and your dog.

Now that you may have a chance of pursuing in the future, but I wouldn't give him any ammunition to play with.

Good Luck, I hope your Dog is OK, and the Walker was not hurt too seriously.

Contact a lawyer. Your lawyer will be able to tell you how to go further, they will let you know if it is worth pursing the case, for example, it wouldn't be worth it if your dog wasn't on a leash, because the attackers owner would say that the walker had no control over the dog. Good Luck with the case!

It is ridiculous that the other owners want to sue you when their dog is the one that jumped out of the window to get to yours!! I do not see how they can get any money from you even thought their dog was injured. Your dogs was just fighting in self defense. As far as you suing them, I doubt that you could recover anything but the $50. You can get aggravation, at least from what I have seen on the judge shows on TV. You have proof of no losses due to what happened. I feel bad for you, but I don't think you have a case. You can ask a lawyer, but he will most likely tell you the same thing.

You'd have a better case if the dog walker who was actually there and injured sued and won. As, the off-leash dog was the one causing the fight and injuries, he should be able to win in small claims court. You could then add your claim, but I doubt you'd win more than the monetary amt you are actually out. All of this would be filed in small claims court. Although very annoying, it probably wouldn't be worth the hassle.

Well the last place to start would be here on yahoo answers... lol.. and honestly I find it hard to believe a Golden Retriver attacked your dog... The dog walker should have been more responsible in keeping your pet safe... Your only tring to sue for money give the poor dog a break if it got beat up don't you think it was punished enough!!!

I should think your dog or the walker could sue but you did not actually get hurt. Perhaps even the retriever could sue but really, your walker should be responsible to take care of your dog. You hired him and he should have been able to handle the situation.

OMG That is so bogus! i got a golden retriever, and they are not aggressive, the guy probably had his dog do that because he didnt like german shepards. i would sue too! you need to go to the police station and tell them your dog was attacked, and tell them the license # , or if you didn't have it, describe the vehicle, but if the walker got the #, have them look up the guy and have them schedule a quart date! thats what i would do.

If YOUR dog was leashed, and the other dog was not, then the court will most likely find that the owners of the other dog are in the wrong for failure to control their dog and for it being loose...even if it did jump out of their car, they should have had the windows up enough that it could not escape.

Go see a lawyer and get them, you'll win.

Sounds to me that you are in-titled to compensate from the ticket and the dog walker for her medical attention. This would be a small claims deal and you won't need a lawyer.
