If the cops a few joints in a house that has 5 people living in it?

Addition: There is me (34) my girlfriend (37), her son (16) and a friend of mine (25). The stuff was found in a common area and in nobodys room.

You would all get cited for possession of marijuana, and the marijuana would then be seized as evidence. If someone was man enough to take the blame, the other three would not face any type of criminal penalty.
The cite would be for H&S 11377 (possession of marijuana/ less than 1oz) More than 1oz is a felony, and you could get charged for possession for sales, which is another felony. That would suck for the people who dont own the stuff.
That is California Law, will vary from state to state.

It may depend on who actually owns the house. It may fall on the owner's head if no one fesses up.

If you are all renting and the joints were found in a common area, then you all could be in some trouble.

Either way, get a lawyer.

It depends on what room thay found them in what age the people are and if no one takes responsibility than the owner of the house would be charged because it's there property.

hehe, well, there is a 16 year old...my find you as a bad influence and a delinquent parent but...eh, id fight your hardest, if your the paretn and your the one smoking, usually they dont do a whole lot...maybe probation for the people living with you. dunno
