The fact of birth in the United States or an outlying territory; or birth abroad to a US-citizen parent who has lived for the qualifying 5 years in the USA. Or the mother for 1 year if the parents are unmarried (sic!).

The birth certificate (or, if abroad, Consular Report of Birth) suffices.

There are a couple of exceptions (birth in the USA to two foreigners, one of whom is a foreign diplomat accredited to the USA; birth to a member of an invading military force . . .)

If a baby is born within the US they're automatically a citizen. If not, and if the parent immigrates to the US, then once they go through the naturalization process, the baby, and any other siblings under 18 automatically become citizens. And if the baby is born to 2 US citizens in another country, the child is still a US citizen.

In the U.S., if you are born here, you are a citizen, end of story. In other countries, it should at least help if you were born there, or at least your parents or grandparents were born there (like Ireland), but in places like Switzerland, that isn't the case AT ALL. Basically, your mileage may vary -- choose your birthplace carefully.

thee 14th amendment of the Constitution states any one born in the united states and its territories automatically becomes a u.s. citizen. this was done to add the slaves who became free to become citizens in the 1860's. some people in congress are trying to annul this amendment to what the parents citizenship are at time of the child's birth.
