Her husband is an American and he lives in Mississippi. He doesn't want to pay for a divorce so I can marry her. He doesn't want to. They were married in Europe. Shhe seems to think I can marry her in the Philippines. Does anyone know if this is true?

You can, but you would be breaking the law. It is probably true that the Philippines has no way of knowing that she was married in Europe, but she would then be guilty of bigamy, and both of you would be guilty of fraud if you tried to get a US visa for her based on that.

Besides, her husband doesn't have to pay for the divorce. She can pay for it herself.

Unfortunately, unless he gives her the divorce, your marriage will never be recognized in the States, no matter if you're married in the Phillippines or not. Of course, you can get married in there, but like I said it won't be official and you won't get to enjoy any benefits that married couples do, in fact, you two can actually get thrown in jail if the government were to find out. If she is living with you or she isn't living with him, then it's strange that he won't get the divorce. I'm not sure what the policy is, but you might try getting a lawyer to mediate.

No, she needs a valid divorce. She can get the divorce even if her husband doesn't want it. Don't risk getting caught up in bigamy charges.
