Kashmir was 'leased' for 60 years by the British, to strengthen the northern border of India, then when the British pulled out the Dogra King (Hari Singh) was given the option of becoming part of Pakistan or India, but instead wanted Kashmir to remain independent. Pakistani tribals, aided by Pakistani troops entered Kashmir to overthrow Singh, so as a defensive manouvre he ceded Kashmir to India, which was made official by the British in 1947.

So technically it's Indian territory - if one recognises the authority of the British Empire.

The region is divided among three countries in a bitter territorial dispute: Pakistan controls the northwest portion (Northern Areas and Azad Kashmir), India controls the central and southern portion (Jammu and Kashmir) and Ladakh, and the People's Republic of China controls the northeastern portion (Aksai Chin and the Trans-Karakoram Tract). India controls the majority of the Siachen Glacier (higher peaks), whereas Pakistan controls the lower peaks.

Pakistan and India both claim it.

It's a worthless piece of real estate. They fight over it because they like to fight each other.
