By having the other parent represent a distinct danger to your child. The problem is, that's their number one condition, too.

The judge is #1, some are decent others are retarded.
However, unless something is terribly wrong with the other parent you may be better off with primary custody where the other parent still gets to see the child every other weekend. It's good for you to get a break as well as the child to know his/her other parent. Of course, I don't mean this if there are any past abuse problems or if your child fears or hates the other parent. However, if it is just because the other parent is "sorry" well you can't change that, and the child is better off knowing him/her than not.

Usually it's the money, at least in my state. Whichever parent has the most money wins the lawsuits around here (CA). Second condition is whether the parent is available to raise the kids, in other words, whether they travel frequently or not. Of course, all of this is null and void if one of the parents has a criminal record or a history of drug abuse.

Right now I am raising my 9yr old nephew because his parent lost him to CPS due to drugs, I"ll tell you what the judge tells them every time we go to court, every six months. All these factors have to be in place, a good job, a descent home, drug and alcohol free, dependable child care.

Most courts decide in the best interest of the child. You have to prove that you are more stable then the other parent.

STABILITY! (Mentally, Physically)... If you are able to show you can handle your own kids, and provide for them. As long as you show you are a responsible adult then you should be fine! Be careful what you do... cuz one lil mis-hap and you can have that held against you. Good luck!
