You ask for it at your first hearing. But why? What is the alternative?

This should not be done without consulting first with your military lawyer.

Of course if you're sending this query from Guantánamo you may never have met your lawyer, or there might not be a hearing, or the authorities may refuse to give you any sort of court, martial or other, preferring to let you rot. But that's another story.

Perhaps you're not in the military at all but like Mr. Karr you want your 15 minutes of fame. Or you are in the military and the issue is whether you are tried by the local authorities or by court martial. In the latter case, the diplomats will decide, not you.

Whenever you are charged with a violation of the Uniformed Code of Military Justice, one of your rights when present with Non Judicial Punishment under Article 15 is to request Trial by Courts Martial.
It cannot be denied

If you are he/she who has done something wrong, there is no choice. Your type of court-martial will be made for you.

Depends what you did. If you went AWOL, the goverment will decide for you, or as a matter fact for any crime!! unless you'r a spy or something of that kind.
