No, according to De Cicco vs Barker, "It is generally held that an engagement ring is in the nature of a pledge, given on the implied condition that the marriage shall take place. If the contract to marry is terminated without fault on the part of the donor he may recover the ring."

it is considered BY LAW as a "gift in contemplation of marriage", which means, no wedding, whoever gave the ring gets the ring back! simple as that! (any lawyer or judge will tell you the same thing)

Yes, if you think enough of her to give her a ring and ask her to commit her life to you, then the ring shouldn't be considered a "loan" as if you'll take it back at your discretion.
