40 lbs for a lab is pretty small and an akita is also a big dog so it's unlikely that it is a lab/akita mix. It has to be mixed with something smaller. Basinji's have curly tails like akitas and are fairly small if it's the tail that makes you think akita.
I would expect a female lab/akita mix to be at least 60 lbs at 2 years.

If there is any Akita in your dog it's hair will grow straight up and be ten times thicker than a lab's coat and an Akita is not as vocal as a Lab or as muscular as a Lab. But the hair is a dead give away because it is the strongest trait of the Akita and it always comes through the breeding.

You would be able to tell if it had Akita in it, but from the weight I would sincerely doubt it. Akitas are not small. A lot of factors could cause your dog to be 40lbs (labs are usually much larger than that). Without seeing the dog or knowing the pedigree, there is no way to know for sure. A pit bull mixed in would be a likely breed, they are much smaller than labs and could give your dog extra muscle and head size which would make it look more "Akita" like.

she might just be a really small lab mix. If she is mixed with Akita (anything is possible) it is likely she would be bigger than 40 lbs, as Akitas are a larger breed than labs.

If your dog is a lab and akita. Your dog needs to eat a lot more! I have a pure bread lab. She is 26 inches tall from her withers (her mid-back)
And she is 80 pounds! And she doesn't look fat at all!

Look up pix of akitas on the net and compare them with your dog. See if you see some of the akita characteristics.
