If you are on the job for a few weeks and the company decides to drug test (not only urine they are doing hair test as well). From what I understand hair test goes back as far as 10 years. If you fail this test you are fired. Is this really legal any where? I mean people change. Is it just certain drugs that show up on that? Please help...

Actually it's not that simple. If you lie and say no, then yes, you are a liar - but you may not get fired. Firing someone for lying about something that happened several years ago (with no impact on their job) might be a short trip to the unfair dismaissals court and a fat settlement. It's actually not illegal to be a liar and hold a job (look at George W. Bush).

Firstly, the company has to obtain your permission to do a drug test (otherwise you have a good case for invasion of privacy).

Secondly, if they do fire you, then you want to get them into court for unfair dismaissal - the cost of their court case on the very ambiguous strength of a result from a hair test would send them realling, unless they really want to get rid of you badly.

Thirdly, claim sexual harrassment just to see them jump about in a panic!

First off, it probably has a lot to do with what state you are in; Im sure you can find info on drug testing laws in your state online BUT having said that, companies can basically do anything they want to you when you are their employee (except if it is prohibited by law: ie sexual harrassment) they can change your job, move you around the office, monitor your phone calls AND email and even fire you for no reason at all. As an employee you give up a LOT of your rights. There is even a company now (no BS) that monitors what you get up to, as in DUI, arrests etc. AFTER you have already been hired. The idea is if you wouldnt have got the job if you did X before they hired you, why should you keep the job if you do it while an employee. Research, but I would say they are w/i their rights; esp. if they are a big corp and have the money to know what they are doing. Now, ask yourself, do you want to work at that company anymore? Was this just you or a whole bunch of people? I wouldnt, thats for sure.

Yes it is legal. Did you not read all the crap they gave you to sign when you started working? Most places have a policy that says they can test you before you start or after you start, and you have to sign the form before. I would think that if they were doing a test that goes back 10 years you would have to have listed if you ever did drugs in your wild and crazy days. But hey check with your employer and read the policies there. Some places give drug test once a week or once a month.

Depends on what kind of work you do. Drugs will only show up in the hair that was formed at the time you took the drug. Let's see, hair grows an average of half an inch a month. Your hair would have to be pretty darned long to go back 10 years.

I kind of think this thing is a little too "big brother" for my taste, unless, of course you are my airline pilot...........

You are looking a little shaggy, don't you think it is time for a haircut? I have always preferred the very close cuts.

I would say that is is legal but I dont know how they could fire you for drugs you might have done years ago. I dont really know how this works I think the harder drugs only stay in your system for so many days maybe thats what they are checking for the ones that wont show in your urine

That depends on the job you were hired for. Obviously being drug free of of prime consideration. It's a random check and everyone is required. If you filled out an application for this job and denied every doing drugs...and get caught, you are done for.
It is one thing to do and and another to lie about it. It's about trust.

Of course it's legal. I don't think it's right to do the hair test just for the reason you mention, but I do think businesses should be allowed to make these kinds of decisions for themselves.

it somewhat is the full objective for doing a drug try... to be certain in case you (or your pal) do unlawful drugs. If there are drugs on your equipment, you're "weeded" out (pun meant!)

you will have to check state laws, but usually they ask you before you got hired if you have ever done any drugs, and if you say no and fail, you are a liar .
