I have a guy that used to be in the Army years ago, but was discharged when his time was up. He is now wanting to rejoin as a Reserve. He will have to be gone for about 4 months for training. We work for a not for profit organization, there are 45 members and 4 of us are paid. My question is does his job have to be held until he gets back from his training? Or does it not apply since he has the job first then signed up again? What are the laws on this?

Maybe I am not being clear. I am not saying we want to keep his job from him. The job we do is an ambulance service. I will have to replace him while he is gone to keep the trucks rolling. The person I replace him with will have to be let go when this military member returns? There are only 4 paid positions with our organization, the other 40 members are volunteer.

Employers are required by law to hold a national guard member or reservists job while they are on military duty.

If he has a paying job with your organization then I believe the answer to your question is yes. Why wouldn't you want to hold it for him since he is obviously wanting to try and do something for our country. If you don't would you please let us know what non-profit organization you are with. I want to be sure and never support it since it obviosly doesn't support our troupes.

When on military orders they can not fire you nor let you go! Whatever he is doing now has to be open to him when he returns. also when gone for a certain amount of time all your interest rates go down to 6%!!!!
