It depends on the laws in the state you are in.
Someone can take you to court for almost anything, the question is whether or not they can win.

No, I don't think so, as long as you are honoring your payment plan. They WILL try to bully you, pressure you, lie to you about consequences, etc. The best thing to say, very calmly if possible, is that you are honoring the agreed to amount, and that you can't commit to a higher monthly payment because it's not in your budget, and you would like to continue making monthly payments in a timely manner. Good luck and do not take any shiiit from these people

yes. normally collection agenices want ALL the money up front, not bit by bit. it's apparent to them that you can't make month to month payments otherwise they wouldn't be dealing with you. they can force you to pony up all at once since it seems apparent that you have money. they will do whatever it takes to get tht money from you. nothing is out of bounds.

I don't believe so. As long as you are making payments no Judge would grant it to them anyway.
