Anybody born within the boundaries of the United States or even within the jurisdiction of the United States has citizenship by birth. That is why so many illegals are accused of coming across the border to have their babies so that the baby can have US citizenship. The parents should get the child a passport and birth certificate as soon as possible. Later, the child can sponsor the parents to get residency. If the parents are deported before they gain residency, the child has to leave with them but still retains his/her natural citizenship and can come back when they are old enough. They need only present their birth certificate and passport to get back into America.

The United States Constitution provides that anyone born in this country, regardless of circumstance, is a full, native born, citizen. Not all countries have this condition (France, for instance, considers the children of immigrant to be citizens of their parents' countries if the parents have not become French citizens yet).
