I wonder how many people realize that two drinks at the company Christmas party can get you thrown in jail. You don't even have to fail a field sobriety test or breathalyzer test any more; it’s all up to the officer's discretion.

If people who have had two drinks are a hazzard to the road then so are people who are sleep deprived and the elderly. They should also be arrested and have their liscense revoked.

Why don't you go back in time to April 17, 1986 and ask my brother, just before he was killed by a drunk driver, what he thinks?

It's not out of hand when a repeat offender recently killed a biker here in CO. The loser hit him, drug he & the bike for 2 blocks before stopping then left the scene of the accident. His prior offense was just 8 months earlier, should have had his license revoked for longer or still in jail. You have the repeat, chronic offenders that go to the bar and drink from sun up til sundown to thank so quit crying and have a DD or call a cab!

I think for to long the laws were to lax. Now because of public backlash they have gotten to strict in some places. I guess it is unfair that some kid can smoke a joint get in an accident and get away with it but if you have a 1/2 a beer and get in a fender bender and the officer can smell alcohol on you and you go to jail it is unfair. But try to tell the mother if a child who has been killed by a drunk driver the laws are to strict and see what she has to say about it.

I was pulled over after a Christmas party one time. I had had 4 drinks earlier in the night, but had stopped drinking for 2 hours before i left.

Cop asked me if I had been drinking - I was honest. He put me through all the road tests - I aced them all. Gave me a breathalizer - blew a .03, way under the limit.

I was nice the whole time, we parted ways without any problems (other then a wasted 45 minutes of my life)

Well basically, if an officer is seeing anything suspicious while driving on a road like if the driver is intoxicated, while driving then that driver will be pulled over by the officer's discretion. Officers have to do their job by saving peoples lives and that is why they have to pull over the driver weather if the driver is intoxicated or if the driver is under aged without a license, etc do you see what i mean when i was explaining to you about the information.

I didn't realize that it is up to the officer's discretion, but no i don't think they are getting out of hand. stop and think about it. any amount of alcohol can have an effect on you, especially if you drink on an empty stomach. would you like to spend the rest of your life knowing that you killed someone if you had a fatal accident while drinking? or how would you feel if you had a friend or family member killed by someone who had been drinking?

It is NOT up to the officer's discretion if you get a DUI or not. A DUI is not going to hold up in court unless you were severly impaired. Depending on how much or how often you drink and how your body metabolizes alcohol all plays a part. You can be under the legal drinking limit but if you're not used to drinking and you're obviously impaired, that's DUI...that also holds true if you're taking any kind of prescription medication, even cough syrup, if it impairs your driving in any way.

Whether you had 2 beers or 12, you give them a reason to pull you over, they are gonna get ya. The rest is cooperation. It's best to cooperate with cops, but to answer your question, YES...I think they are being extremely strict with DUI's. I dont know about you, but I have not seen many statistics b/c of the emergence of tighter laws.

No. Two regular drinks won't land you in jail. And no, the police have to administer FST's and/or a breathalyzer to determine. It's only when the driver refuses to take them when the police can immediately arrest. (Or when they are just plain falling down drunk).
