Many criminal offences are punishable by jail time. I read in the press that a state is filing criminal charges against a company. What I don't understand is how is the office punishable if the crime related to something that was punishable by jail time?

People are always responsible. If a corporation, like Enron, broke the law due to the actions of its officers, they are both guilty.

For example, Sabanes Oxely is designed so the the key officers of a corporation have to sign off on the financial statements for the corporation. If the financial statements are wrong, the officers are directly lined up to go to jail, since they assured, per SarbOx that the finances were correct.

Company officers may be liable, if it comes to jail time.

Other than that, the fines will be assessed against the company, since most crimes allow for combinations of fines and prison time.
