the auto body shop gave me an estimate of 4 to 5 000 $ .
my car doesnot cost that much . the insurance company is offering only 633 $ and disagrees with me to total the car .
there was no damage prior to the accident made to the car on the rear end side.
they argue that the other car that hit me does not have even a dent then how come my car have this much damages.
i know that my car did not had n e damage on the rear before the accidednt.
based on the automobile source they think that the actual cash value of the car is 1900 , and they have didcted all other damges , that are not because of an accident.
please guide me what i should do in this case.

Although you're taking a beating by asking this question, there are inconsistencies that are obviously causing issues for the insurance company. It is not often that you see one car with a lot of damage and another with none. Did an actual claims adjuster from that company see the vehicle and do an estimate? If so, what items on the other estimate are left off on the insurance company's estimate. And yes, they can tell if damage pre-existed.
You can turn the claim into your insurance company, but what if they say the same thing? They are more likely to take your side if they're satisfied it's related damage, but who knows?
Also, unless you sign a release with the other company, you're not bound by accepting the check and unable to still pursue the other damage. Most people just don't want to take the check unless it's for everything.
Sounds like there is more to it than what you've told us.

it is hard to answer the question as you do not state what type of car you have vs the other car involved. you might want to ask them why they do not feel all of the damages are related to the loss. You also do not explain if you were hit dead center or on the rear towards the side-- it makes a difference When you have an inexperienced adjuster who does not understand vehicle damage well (they are out there, believe me!). If they cannot explain why they feel it is unrelated, as to speak to a material damage/property damage supervisor or manager to have them better clarify it for you. If they cannot explain it to you, call your insurance co and speak to them for additional help.

You need a lawyer. However, in the end, you may break even once you pay the lawyer and get your insurance money. Call your own insurance company to see what options you have, if any. Good luck, this sucks!

#1: what kind of estimate is 4 to 5K dollars? That's no estimate, dork.
#2: a seasoned damage appraiser can spot prior damage. Ask them to show you what they found, NOT the body shop.
#3: unless your car is made of balsa wood, it has not suffered $5,000.00 in damages if the other car (unless it is a military issue Humvee) only had a dent in the bumper.
You are either lying or leaving out some key issues or just dumb.

File the claim with YOUR company, pay your collision deductible, and let your company hash things out with the other company.
