yet still apply to the US even if they seperated and how long will it take and what if there from a middle eastern country. And what if there visa is still pending since they got married and can they cancel it and the person start over even if there are no relatives in the US.

You have to have been married for two years (possibly two years from filing, but I'm not sure) before you can get divorced and retain your visa.

I suggest calling the INS helpline for an official answer -- they're much more helpful and straight-forward than you might imagine.

No. If your visa was pending your divorce cancels it. You need to go back to your country. If you stay in the US illegally for any length of time and you apply for any kind of visa in the future you will be denied. You might even get a 10 year bar.

Have you received your Alien Registration number yet or are you just applying for the number.

I assume you are talking about a green card. Before you can apply for the card you have to apply to get a number, when your number is issued then you can apply for the card.

Either way your spouse would be needed for your application to be succesful as there are interviews needed. Without the spouse you are out of luck.

And no you cant apply on your own unless you fall into another applicable category.

The pending visa will be cancelled and the person will need to leave US.
