My ancestry is that of brazilian, italian, and french (yes, they went around :) ) anyhow I will be moving to England next year with my husband. If I decided to have my child in England would he or she be consider illegal if in 10 or so years I decide to move back?

*Both my husband and I are A.C.

A child born to an American citizen parent is an American Citizen, no matter where the child is born. There are some documents you'll need to file with the U.S. Embassy. Born a U.S. citizen, always a U.S. citizen unless you renounce your citizenship.

I see there is a lot of ignorance out there about immigration law. First, when your child is born, all you need to do is have him registered at the nearest embassy. Then, through the embassy, apply for your baby's passport. If you can prove to the embassy you are a US citizen, you should have no problem whatsoever to get him/her a passport. In recent years, new legislation and procedures have made it easier for parents in your situation to get proof of their kids' citizenship. So dont worry! You can give birth to your kids even in China, if you want, they will still be US citizens. (However, if born outside the US mainland, they will never be able to become US Presidents. Senators and Congressperson, yes, though.)

Your child will be a British national because he will be born in England and will not be a US citizen. Thus, he will be an illegal entrant to the US if you do not pass through the proper procedure.

If one of the parents is an American Citizen then your children are American Citizens whether they are born in the US or not. My daughter was born in France and she has a US passport. Just check with the local embassy and they can tell you all the necessary steps to take after the birth.

Illegal where? In your home country? (Check their laws but typically I think if parents are citizens a child born abroad is.)

Illegal is only if you enter a country without government sanction and seek to work and live there..your child would be english if she/he were born there and had a birth certificate to prove this

no country can deny citizenship if you are born there in your case your child will forever be a British citizen no matter where you live your child will always be British unless the child renounces it
