Usually the military courts will act towards military law. Cocaine use is not a serious offence unless you add possession. If you are in the states, the military will probably grant an undesirable discharge; then they will turn over the cocaine evidence to civilian law enforcement. This law was changed about ten years ago. Now the military in a certain state, abides by their laws, as well as military law.

No you failed a test that is not illegal in civilian courts. Military courts tend to be severe. You got a general discharge instead of a dishonorable tells me you have nothing to worry about this time, however Texas takes a very dim view of drugs so I would clean up my act if I was you before you get a real felony.

If you were given a court martial then it is a federal felony. That means it does not matter what Texas thinks. You should have taken the Article 15. Or something real crazy and not snorted coke in the first place.

Seems to me that this information should have been given to you at the time of your Courts Martial, but if you received a General Discharge it is considered as other then Honorable but that you are unfit for military duties. Loosing all you pay and whatever benefits you had coming is considered to be punishment enough under military fairness, but you are still considered an unfit person for anyone to rely on you. You disgraced yourself and the honor of wearing the uniform. I certainly hope that you realize what you did and set yourself straight.

What type of Discharge did you get? if you received A DD or a BCD you have a felony drug Conviction. Any thing else it is most likely a misdemeanor

Not too sure of the felony or not thing, but let this be a lesson to all don't do anything you are not sure of the consequences of, or you could look at it like this what a great way to get out of the forces.....cheers...

no, military justice is not the same as civilian, you will just have a dishonorable discharge. But if it was handled by the military, it is not a felony.
