i use to live in philly and now reside in jersey city since feb 2006. butt my debt problem have alwayz been goin on for 6 yrs now... i have a court date in sept 9 and have only 2 wks to find a lawyer... which i didnt even look for yet. if i get a jersey city lawyer, would they have to attend da court date in philly? or can the matter be solved here? and let's say i have a job and can't get that day off? wat would happen? would they excuse my absent presence and proceed with the filing for bankrupcty or do i still have to show up?

I'm not sure Echo's advice about a change of venue will work for you. I don't have enough information about your situation.

The case can be filed in the state where the action took place, and it's not always necessary to file where the person lives.

Since we are talking about changing venue to a new state, it would require the suit be refiled in the new state. You can bet the creditor is going to fight such a motion.

Another problem is residency. You must have lived there the "better part of 180 days".

I'm confused about what the case is about. You mention "filing for bankruptcy"? Or is this a judgement suit where a creditor is suing you?

If it's bankruptcy, you must attend the hearing, or at least the creditors meeting. You can't get out of that. The final discharge meeting can probably be handled by just your attorney.

If this is a judgement, you can be represented by an attorney and you don't need to be there at all. The judge will not even listen to excuses about how you need to take time off from work. The only thing they might do is reschedule the date to fit your schedule.

You will have to go to court in the court where the matter was filed. That would be Philly. If you don't show up, the person suing you will automatically win the case against you and you will have a judgement against you for the amount owed. They will then be able to garnish your wages, levy your property, or levy your bank accounts.
