We know the child is his and he hasn't seen the child in over 6 yrs the mother lives in California and my husband really would like to spend some time with his first son.What/How would be a good way of going about this?

You know where the child is, so make a phone call and schedule a time to visit. Does he have a visitation schedule? If so, do you think the mother will obey it? If she won't, you'll have to get an attorney involved.

First of all, I congratulate your husband for paying child support. There are too many parents that don't. Secondly, Is there a reason why your husband hasn't seen his son in over 6 years? I know you said that the child lives in California, but If it was my child, I wouldn't have let it go for this long. If the situation was reversed and he had his son, Do you think the child's mother would wait six years to see him? The best thing for him to do is to try to communicate with her and come up with some type of agreement. If that doesn't work, he need to contact the Friends of the court and let them assist him and seeing his son. Good Luck to him and you.

Tell your father to contact his lawyer to have visitation rights with his son. The courts are changing now and he should be granted taht time. I understand the child lives in California but i'm not sure where you are, but if he is willing to go there or have the child come to you guys he could visit over holidays when the child is not in school. Your husband should be allowed this if he isn't behind on payments.... GOOD LUCK!

First you must file to ammend any child visitation agreements made in the past. During this process you will request specified visitation.

Once this is done you will be able to enforce visitations with the child.

Doing this alone, depending on what state you are in should take aproxamately 8-12 mos.

Get a parra legal and it can be accomplished in 6 mos.

There is no need to pay for an expensive lawyer unless she plans to declare him unfit.

If the mother is uncooperative, then it will be a matter for the courts. You don't want that. Parents should be glad that the absent parent would want to see their child and establish a relationship and responsibilities. On the other hand, if she is keeping the child away, he should get an attorney and get going on getting either visitation or custody. Good Luck!

You would have to get a visitation order from the court or ask the mother to let him see his son. Child support and visitation are two seperate orders. Your husband would probably have to call the county courthouse where his son lives and see what the process in the county is.

Child support and visitation are two very separate things in the eyes of the court. He needs to find a lawyer and fight for visitation. If he goes to court with the attitude "i'm not paying for a child i can't see" or "if i'm paying for this child i want visitation" he will most likely lose.

Good luck, my fiancee lives minutes away from his girls.Pays on time and SHE has decided that his rights as a parent have been terminated. He has spent a bloody fortune trying to get the courts to intervene (he has been granted visitation rights by the court,applying it ha!) She( the mother) will not even allow him to speak to his girls on the phone. The law is very bias when it comes to the fathers rights, they could care less about the dads.
But it's okay to have a live in boy friend .. sickening
