My little bro got in trouble at school for touching a girl on the butt. He is only 12. The girl hadn't said anything but, her mom came to the school&told my mom&the principal that her daughter said my brother had been doing this all along. The woman also said my bro had been calling her house & hanging up. My little bro did admit to this because he&his friend were prank calling....I know that's a big deal&doesn't help his case, but children prank call all the time. My bro admits to making the calls but denies touching the girl. He said he touched her once because someone pushed him&he bumped into her. The other thing is my bro said that the girl has touched him too, because she once hit him in the face&knocked his glasses off. Also this little girl has also claimed another boy touched her,&she's been n a fight recently where she stabbed somone with a pencil. The mother wants to sue my mother. Can my mom sue 4 assault? Also can she bring up the other incidents the girl's in?

It is probably in the best interests of both parties to talk to their kids and explain the situation and any punishments there after. I doubt the mother has a suit due to the fact a 12 year old is pretty hard to form this type of irrational sexual behavior at this age. Most of the time is simply classified as flirting, youth, social experimenting, ect... Same goes for your mother in her counter suit. If this did go to court the child's behavior toward others establishes a pattern. Please tell your bother not to prank call her anymore and do some light documenting on the other girl's behavior towards him and others. Remember you need date, times, people; not he said she said stuff that will not be allowed by the court. Also to stay safe tell your bother it is in his best interest to try and stay away from her.

Anyone can sue anyone for anything. I could sue you because I claim your screen name caused me emotional pain and suffering. It might get thrown out of court but it would still force you to come to court, maybe hire a lawyer and basically waste your time.
I think the best thing here would be for the parents to sit down, be adults about it and talk this out.

Technically if the boy is over the age 8, he could be punished for for the crime. Anything less than 8yrs of age, the parents are responsible for.
Your mom can't sue for assault she could only file a report.

Funny, cuz - my little boy says this girl in class is constantly trying to touch his privates... BUT, guess what? Its a double standard. Touch a girl, your in deep trouble. Touch a boy it gets shrugged off as horseplay. I'm his father and I use common sense. I'm not going to ruin that little girls life because she likes to play, and I refuse to mame an issue out of it.

....your little brother is kinda in a pickle cause if you are a home owner they will sue you for about 10 grand then you will be forced to put your little brother in counseling and the school will be notified of all things... the school is not your friend here... tell him to keep his mouth closed and only talk to your insurance or there attorney... had a son do the same thing at 11 and it was all in fun but he only did it cause the girl pinched him but nobody seen her do it just my son .....good luck in this....they settled for 11 grand

of course your brother is going to deny it, but i think he probably has been touching this girl all along. it happens A LOT and i'm not sure how to deal with it. my daughter was harrassed by a boy in 6th grade and she eventually had to kick him in the balls to make him stop.
sounds like the girl hit him in the face becasue he was feeling her up. wouldnt you do the same?

Sounds to me like all the kids involved need help. And that should be both mothers big concern.
Not everything has to go to court...som times common sense does more good.

hey I'm13 i was 12 a few days ago well e n ways a dude slap me on the *** i didn't care because i got him back but i didn't touch i hit him back, but he and i both knew he was playing but i didn't get mad it was OK . yes ur mother should definitely bring up the girls accident. well good luck yes and at this age we flirt alot!!!!
