I am in OH. Who knows what the laws about minors getting picked up for curfew voilation are?
My daughter (age 16) was out with my permission 2 blocks from home getting coffee from a 24 hour gas station. She was picked up for curfew voilation (I didn't know there was one) by our "wonderful" police department. She arrested, patted down by a male officer and handcuffed in the back of the crusier, then to a wall at the station for 45 minutes total before I was called to come get her. Is this legal??
Keep in mind, she has never had a bit of trouble before this. She did not "mouth off" to the arresting officer, and they confirmed that.

Ok...apparently I need to add to this...I am more concerned about her being handcuffed and patted down by a male officer...I have talked to other people who have told me it is not legal for a minor to be touched period, let alone by an officer of the opposite sex. Also, from other people I have talked to, it is illegal for an officer to handcuff a minor unless it is for a violent offence.

Yes it is, just because you had no idea of the curfew doesn't excuse you or her. And if your area has a curfew it must be having a problem with crime, and as such your daughter was suspicious for being out past curfew.

And the wall for 45 minutes thing isn't that big of a deal, suck it up.

Instead of pleading guilty to the ticket for the curfew break, go to court and explain all that to the judge- maybe he'll hook you up.

I didnt know there was a curfew in ohio. I grew up in Deleware county and when i was 16 i was out driving around by myself after 10 and 11, which is when most curfews take effect. I know me and my boyfriend got caught at mingo park by a police officer at around 1130pm one night, and all he did was ask if i was okay and tell us to go home right away.

So i think its kinda interesting that your daughter was picked up for getting a coffee.

Actually I would have jailed you too if you gave her permission to be out that late. Don't you know how many wackos are out there late at night? What kind of parents lets their 16 year old girl out that late??? What kind of parent lets a 16 year old drink coffee late at night as well? You should look at what kind of parent you are I think. The reason they have these entirely legal curfews is because of negligent parents such as yourself who are either to disinterested or too stupid to keep their kids off the streets at night.
