The border patrol tried to make her go back to Mexico but she said her baby was an American citizen. If you have your baby halfway in Mexico and halfway in America, what is it?

There is a doctrine that says if someone is in the 'port of entry' they are considered outside of the country as a legal fiction because they have not been allowed in. I don't know if that would apply here.

However, since having a baby as you climb a fence is pretty unlikely, I don't intend to get into it in much detail.

you cannot have a baby while you are climbing over a fence. Also, just because your baby is American (if they agreed that it was) does not mean the mother has the legal right to stay in the US. A child cannot help its parents become legal in the US until the child is 18 years of age.

The half that landed on US soil is a US citizen. The rest gets sent back to Mexico.

That's rediculous. She was ILLEGALLY crossing the border. If she didn't make it all the way across, send both of them beck to Mexico! I am so sick of having to pay taxes to support them on welfare! Stay in your own country, or come to the US LEGALLY. Get a job and support yourself!!!!!!!

theres not such thing has half and half....the fence is half i guess...but im sure the baby wasnt born right on top of the fence...although that would be a funny sight...it depends on that side of the fence it was born...simple as that...
