I am tring to find out about a law that I have heard of that a lawsuit against a soldier can be set aside so long as they are overseas, until they returnto the united states? Has anyone heard of this law, and if so what is it called so I can research it more fully?

It sounds like you might be referring to the Soldiers and Sailors Act. This is normally used to prevent military personnel that are stationed overseas from becoming involved in a court case that will require their presence in court.

This is totally true! This happened to me six years ago in Virginia. I had a civil suit against my ex who was in the Navy, and because he went underway and left the US, the courts put it off until he got back home months later. He even knew the court date was coming up, but it made no difference to the courts or his Command. Shortly before the trial was to start, I received a call from my attorney telling me about this and there wasn't going to be anything I could do. He said that he has personally seen this more then once in the court system in Virginia, I guess because Norfolk is such a large Navy base.
I don't recall ever hearing a name for this law, but I guess there probably is one. I do know that unless it's a criminal hearing where the service member is the defendant, you're just screwed until the person comes back from overseas.
