You know, there's this cool picture of a random guy or something and you want to use it for a commercial at church or for flyers. Do you have to worry about it if it is like 10 years old. I have this catalog of pictures from this company on a CD, and I don't want to have to pay them so I hope the rights are expired and I can use them.

Do a web search on public domain clip art and photos. There's lots of stuff out there that IS free. But don't steal a person's way of earning a living just because you are too cheap to do the right thing.

Per the Copyright Law of 1977, the rights to any copyrighted work expire 75 years AFTER the death of the artist. So yeah, you using the photo would be in violation of copyright law. If you are using the photo to advertise or for anything that could make money, you could be sued if anyone finds out. I don't think the congregation would look kindly on that.

Considering how it's for Church, maybe you shouldn't steal it. Artists already make no money without people taking bread from their mouths.

However, you can call them and ask for permission. IF the company is a co. that sells images, they won't let you use it without paying. But if it's something else, maybe they'd grant you permission, in which case you'd have to credit them on your flyer with "image from XXXXX, used by permission", or something to that effect.
