Can I drive in the car pool lane with my 1 year old daughter in my car? If not, how old do you have to be?

She should qualify. It just says "persons" on the sign, it doesn't specify an age.

Don't be surprised if you get pulled over by the police and get a ticket for breaking the law!

The definition of carpooling is: Carpooling is the shared use of a car, in particular for commuting to work, often by people who each have a car but travel together to save costs.

A 1 year old baby does not work, own a car or even earn an income so how could it be considered as a carpool entity? Unless your daughter is working and is going to her job, you are breaking the law.

It's safe to assume the minimum age for a worker would be 18 years old.

As the police or traffic court judge would tell you, "ignorance is no excuse for breaking the law".

Sorry, but you and your baby will have to stay in the slow lane to be legal.

Just a suggestion -- why not call your state DOT or State Police and just ask the question? You see, there are already 2 very different answers, so it must not be a commonly known thing. You have a very legitimate question, you really don't want to get a ticket (uggh! Points!!), and if you could qualify for something which would make your day easier, you should do it. You just need to know -- call. It won't take very long and then you'll know.

Good luck!
