The Sheriff stopped you because you were speeding,he was just doing his job,I don't understand what his sexuality has to do with it.

I agree that you should not ask a cop if he is gay. He has some power and you don't want to alienate him if he is straight and threatened by the thought of being gay.
If you were abusive toward an officer, I suppose he could charge you with something. Even though a sexual preference question can be asked in an abusive way, it would be hard to explain to the court that a sexual preference question was abusive.

Homophobia is common even in gays. Many people don't want to share sexual orientation. Before asking if someone is gay it's good to compliment their appearance. If you are not interested in dating them or introducing them to a perspective mate it is none of your business.
