Unfortunately, you are going to be held liable to pay his insurance company. If you already paid him cash, and he has also filed a separate insurance claim, then he certainly is committing fraud. If you have any type of proof that you paid out of pocket (hopefully, you wrote a check and this may be sufficient proof), then you may be able to get the insurance company off of your back if you tell them to go after him for the payment. If they won't budge and continue to ask for payment, you minus well just hand it over and take this as a hard lesson. However, if it was a large sum of money, you may want to contact a lawyer to help you, but the cost of hiring a lawyer most likely will outweigh the money you are to pay back. Just be persistant, show as much proof as you can, and if you end up paying the money back, try to take him to small claims court to reimburse you as he has financial gain in this situation.

If he did not sign a legal release for you, you will owe the difference if it's related. You should see if your insurance company will step in here. The only problem is that by not reporting it you could have prejudiced their ability to handle the claim, they may not cover it. Most policies also say that only at your own expense will you pay for someone's damages of out pocket, so basically don't expect to get them to reimburse you what you paid. Out of pocket settlements ALWAYS fail. No matter how minor or the effect on your policy you're better protected using your insurance.
If your payment is for the same damage, he can't collect twice, so submit proof of your payment so you can at least be off the hook for that.

Don't ever give cash payments in that situation. The only way out of your situation is likely to be a court battle.
Oh, and get car insurance for yourself.

if you did not get a receipt from the guy or he will tell them that you paid him cash your probably going to pay again. any reason you did not turn it in to your insurance in the first place

talk to his insurance company. He commited fraud. However, since you probably did not get a signed receipt from him.... and probably was not documented by a police agency.... you cant prove your case... and in the end.... you'll have to pay.
