If someone has been in the military and has been out for a number of years and a draft is started can that person be drafted after volunteering the first time

ok my husband did 4 years in active duty (army) 8 years inactive (meaning he could be called back at anytime during that peroid) on Sept 12, 2001 he got his FINAL DISCHANGE papers in the mail not his dd214 (got that when get got out). If a draft was to happen today could they call him back (forcefully)

If that person has special knowledge or skills, yes. It happend to several people I knew at home when I was in the first gulf war back in 90-91

The previous poster has it correct. Initial military contracts are for 8 years. Whatever time you serve active duty counts against that 8 year obligation and any remaining time is spent in the active reserve (1 weekend/month, 2 weeks/year) or the Individual Ready Reserve (IRR) which is one day per year to be checkout out. At any time during the reserve time you can be recalled.

Once the 8 year obligation is up you can not, under normal circumstances, be recalled INVOLUNTARILLY to active duty. Certain specialties such as the SEALS have their own little rules that you and I will never know fully.

When you chose to make the military a career and "retire" from active duty with less than 30 years you are not actually retired. You are, instead, transferred to the (in the case of the Marines) "Fleet Marine Corps Reserve" and you begin receiving "retainer pay" until you reach 30 years. During that time, you can be recalled as well.

This does not mean that the military can not call you up after your 8 year obligation and ASK you to return to active duty. During the 1991 Gulf War, there were a LOT of old sailors that were recalled to active duty to bring ships out of mothballs and put them into service. The reason was that the "NEW NAVY" didn't have the expertise to do the job.

In the current way, while I have no personal knowledge, I am sure they are calling up just about every MP and bomb squad personnel they can get ahold of and asking them to come back to active duty to help out.

You can not be drafted at any point in time. You can be involuntarilly recalled to active duty at any time during the 8 year obligation.

OFFICERS are different and some officers even have a 6 or 8 year Active Duty obligation AFTER training, particularly pilots, where the military has a large financial investment. I'm not sure what their recall procedures and regulations are....

That's because I was enlisted and worked for a living.

When you sign up, you sign an 8 year contract. It consists of your active duty time and the rest is for active or inactive reserve. Active reserve is the 1 weekend a month 2 weeks a year deal, and inactive reserve is for just in case. after the 8 years you shouldnt be able to be called back.

I just heard something recently on the news about calling up retired military personnel, so I would say yes to your question. The news also mentioned that these military people knew it was there duty. I also personally knew of someone in the Navy , retired and in his forties with wife and kids, has his own business, and had to go to Iraq when the war started. It sucks and it's scary. Good Luck

Yes. In the event of a congress approved draft, you may be called up until age 26.

In most cases, when you enlist,you sign a form stating that when you leave the service you can be recalled at any time depending on how long it's been since you left and /or out of necessity such as a national emergency or war.

you better believe they can. as soon as your service is up, they have a 2 year window that you can recalled back to active duty. not until you have your dd214, you can be recalled back to active duty. especially if your MOS is highly needed.

Drafted, probably not.

Recalled to active duty, most likely.

No, they can not be drafted, but, as the other person said, you can be recalled.. had a chief when I was aboard USS Nimitz who had been on the disabled list, and they recalled him because of a shortage of his rating.
and then put him in charge of our ordnance shop, and him an electrician.. wierd.

Right now, unless their wheel chair has flat tires or their seeing eye dog has cataracts... they can be recalled.
