full custody and you are worried about your child being with Mommy, yes prove it! Talk to a lawyer though, its crazy how much of a difference it makes!

If you are married and both good parents this is what seems to be "normal" nowadays. There will have to be no proving anyone unfit.

If you aren't married, I am not sure of what you would have to do to get joint custody. I think that a judge likes to see a dad that is very interested in his child. You would need to ask your lawyer what the best route is. They know all the laws in your state.

No, not for joint custody. If you were seeking primary custody, the answer would be yes! Because most judges award primary custody to mom, joint custody is what they are wanting you guys to do.The baby NEEDS both parents, as long as they are "fit". You will have to go to a mediator, if you haven't already done so!!

If the Mother is "unfit", why are you filing for joint custody and not physical custody? Seems to me that if she isn't fit to raise her child then you should be looking at what is in the best interest of the child.

If you are filling for Sole custody you would have to prove the mother to be unfit but for joint you dont. Remember the courts do favor the child being with the mother.

if you want to have the kid full time then you say shes unfit but if you want her to have joint custody sit down with her and talk about it with her. if she head strong and want the child to only live with her then i would throw the un-fit parent thing on her but thats only if you can handle taking care of a child ALL THE TIMe.. there are other options like having the kid in the week and her having them on the weekends. thats what i would do if she is un-fit.

no joint custody give both parents legal rights on education and how and where their child is to be raised how ever if your seeking full custody you will have to have proof that the mother is unfit to raise the child. 90% Of the time the courts give the children to the mothers rather than fathers reason being is mothers tend to be more nurturing than fathers.

ABSOLUTELY NOT! You can apply for joint custody because you LOVE your child and want to be in your childs life! I think its an awesome idea! Kids need BOTH parents in their lives!!!! But no- u dont have to make her look like crap to do so. Make sure you have a job- and a place where the child has their own room and there should be NO PROBLEM for you atleast getting your child on weekends! Good luck to u darlin! NEVER give up on your kids!

Only if you are filing for full custody or maybe if you are trying to have the child stay with you at your home and the mother visits.

Not that I am aware of.. In mosts states you only have to prove a mother unfit to get FULL custody of a child.
