Of course it is legal. Why not? You are not seriously considering using that as an excuse are you?

Yes, as long as there was probable cause for the test to be administered. The medicine you are taking should not affect the breathalizer results. If you feel strongly about not taking a breathalizer test then request a blood test and explain your reasoning.

If you are subjected to a breathalizer test and "fail" you should be able to request a more conclusive blood test. Also have documentation from your Doctor, Pharmacy or the drug maker that the medicine you are using may prejudice a breathalizer exam, although as mentioned earlier you may may be just as guilty for knowingly being under the influince of another "drug".

If you HAVE to take a breathalyzer then it must have been court ordered, or requested by a Police Officer at some point?

So they should be made aware of any medication that may cause you to fail this test. The particular medication that you are taking (if in pill form) wouldn't effect such a test in the first place. Breathalyzers are based on alcohol consumption, and registers alcohol content in the breath. Narcotics, legal or not do not show up in this test.

Oral medications show up in a "urine tests" and blood tests!

But perfectly legal for anyone to be asked to take a breathalyzer.

In many states, if you are impaired by anything (even prescription medication) while driving, you can get a DUI, and part of that process will probably involve a breath test.

I teach traffic school in Arizona and I know the DUI laws inside and out, and I have had DUI students in my class who got a DUI on prescription medication, took a breathalyzer and/or urine and/or blood test, had NO ALCOHOL in their system and still got the DUI.

medication shouldn't effect your ability to pass a Breathalyzer, maybe i dont understand the question.....
