ok-someone was in the Army and they were jailed. During the jail time the army kept paying said person the monthly salary. The jailed individual did not know that they should not be paid during that time. (approx 3 months of pay) Close to 4 years later they get a notice from the Army saying they were paid in error and it needs to be repaid. Now what I want to know is- Does this have to be paid back? It was an error on the Army's part and wasnt even known to the person to be an error until years later. Serious answers only please

Yes, The Army takes what it wants, when it wants, and because it wants! Trying to get them to justify their actions is like talking to a brick wall, you get nothing! That is just how the military is and always been. They will say it was your responsiblity to know of the mistake and pay it back or hold on to it till they came for it. I know, I am in that situation myself. I tried to get an enquirey about why they think I owe them more money when they have already taken 6,000. dollars out of my pay check for a 3,000. over payment that they did. Now they say I owe them 1,500. with a high intrest rate, and the enquirey will take up to 6 months if not more, mean while my intrest is growing. They make it where you can only bend over, and close your eyes, hoping it wont hurt. Thats the military way......... bend over and just take it!

The fact that the army is sending notice that the money needs to be repaid sounds like it does. Otherwise, it's an ethical question--"Do I do the right thing and return the money or not since I wasn't supposed to have it." But now that the army has discovered its error, it's asking to be repaid. I trust the army will allow for a payment schedule if the lump sum is not readily available.

It doesnt matter if it was the Armys fault or not. If they werent supposed to pay them the Army will take it back. One way or another they will get there money back.

One thing I learned along time ago. If you aint sure about your money dont spend it till you find out the fact. I know your situation is a little diffrent. Im actually Im kinda suprised they caught it 4 yrs later.

The Army doesn't ask for repayment, they take it right out of your check. This is what is called a 'No pay due'. And they will do this until you are paid up. It happens all the time.

yes, he may have to pay it back. I know it varies by state for private companies to ask for money back. He needs to check with a lawyer to see what his obligation is. There is a time limit but that is what will determine if he has to pay it back. Lack of knowledge of a law does not nullity it. Same here, lack or knowledge does not mean it did not happen.

it has to be paid back. otherwise legal measures will be taken.

call it the big green weenie. all service members get it in ther rear at one pount or another.
