I live in so cal and was sited for speed contest with no radar/laser involved. officer said I was doing 80+ but I was about 80 ft from him before he stopped. I accelerated up to speed with a friend and then let off...that's when I saw the officer and at the stop sign. By the time he caught up to me and pulled me over I was about 1/4 mile from where I turned right. He stated that "he had hadn't even stopped and I was already gone." On the ticket it shows that I was doing 80MPH + in a 35MPH when it was actually 40MPH Zone. Also my bike was not impounded. Just wondering if anyone might have some insight on this.

Also I contacted a friend that was cited for speed contest he got his car impounded. He recieved advice from a judge (indirectly) about the matter. He told him to plead not guitly and take a public deffender. He ended up with a $500 fine and 1 point on his record. I am going to the same court house my friend did so I am hoping that the chances are that I will get of easier.

If the speed limit sign doesn't have a signature on it, like a small GPD for "gramby police department" then it is a private speed limit sign and is therefore not legally binding against you. If you find out that is the case, take a picture of the sign and show it to the judge. My step-dad had his friend who is a lawyer tell him that and it got him out of a ticket. Don't speed just to use it though because they can replace signs all the time and they could still fine you for wrecklass endangerment if you are going 40 over the limit. It's not fool-proof but give it a shot, it couldn't hurt.

Definitely fight it. At least make sure you get cited for a 40 mph zone.

The reality is...your best bet is to appeal and hope the cop doesn't appear in court.
